Please read these terms and conditions carefully before ordering products from our site. They will tell you who we are, how we will provide you with our products, what to do if there is a problem and other important information.
If you disagree with any part of these terms and conditions, please do not use our website.
1. Information about us
1.1 www.gardendesignsforall.co.uk is a website operated by The Garden Store LTD (“We” “our”, “us”). The Garden Store LTD is a company registered in England and Wales. Company number 16018595. Our registered office is at Carlton House, Maundrell Road, Calne, Wiltshire, SN11 9FA.
1.2 We are a garden design company that provides pre-planned and bespoke garden design packages. Our products include masterplan, dimension plan, planting plans along with information about the plants, a plant schedule and maintenance guidance. All products are sent electronically in PDF format.
2. Ordering Our Pre-Planned Products
2.1 You can place orders for the products with us by following the process outlined on our site. You acknowledge that by placing an order with us you will be under an obligation to pay for the products in that order.
2.2 Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each stage of the process.
2.3 The address that you provide will be visible on each page of the PDF product provided by Garden Designs For All. The product can only be used for the address it was purchased for and as stipulated on each page.
2.4 Payment in full is required at the time of ordering. On confirmation of the cleared funds into our account, the product will be sent via email within five working days to the email address that you, the customer, has provided.
2.5 We hold the right to cancel any order that is placed. In this case, we will contact you to issue a full refund.
2.6 Unfortunately we cannot cancel your order once the PDF product has been sent to you.
3. Ordering Our Bespoke Design
3.1 You can place orders for the products with us by following the process outlined on our site. You acknowledge that by placing an order with us you will be under an obligation to pay for the products in that order.
3.2 Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each stage of the process.
3.3 A payment of 50% of the overall design fee will be required from you at the point of acceptance of the quotation. We will send you an invoice which you will be required to settle via bank transfer by the date provided. On confirmation of cleared funds into our account we will begin our design process. The remaining 50% fee will be invoiced to you and requested to be paid once the design is completed and issued to you. This fee is to be paid within 14 working days of the date of issue.
3.4 Amendments can be made to the design package but must relate to the confirmed design brief.
3.5 Your order cannot be cancelled once you have accepted the quotation, and the 50% fee has been paid.
4. Availability
4.1 We will inform you as soon as possible if, for any reason, the products you have ordered are not available or subject to any delay.
4.2 Garden Designs for All retain the right to change, update, add or remove products at any time. We may do this without notice.
5. Images and Sizing of Products
5.1 We use 3D computer models and computer-generated technology for illustrations on our website and within our products. We endeavour to represent materials and our planting schemes accurately; however, this is not always possible due to some plants or materials being unavailable within the computer software.
5.2 Our products have been prepared for different sized gardens and are provided in different categories. Each category has a pre-set and described dimension. We have the right to alter these set dimensions and or add new garden sizes at any time without warning. It is your responsibility, the consumer, to select a product that best fits your garden.
6. Prices of Products
6.1 The price of any product will be shown on our site.
6.2 The price of any product may change from time to time, but changes will not affect any order that we’ve accepted.
6.3 Sales, offers and price reductions may be provided at any time. Said offers will be advertised and withdrawn at any time. The offers will not be open to purchases made using a pre-paid voucher.
6.4 Bespoke designs are individually priced based on your requirements and the size of the area being designed.
7. How to Pay
7.1 We accept payment with the payment methods listed on our site. You must pay for your pre-planned product in advance of receiving any of the products.
7.2 By submitting an order to us through our site, you are confirming that the payment details provided on your order are valid and correct.
7.3 For our bespoke design service, we will send you an invoice which you will be required to settle via bank transfer by the date provided.
8. Delivery
8.1 The pre-planned product will be sent via email within five working days to the email address, that you, the customer, have provided. Garden Designs For All cannot be held responsible if the email and product fall into any spam and or junk folders.
8.2 If purchasing a bespoke design product your design will be sent via email between 14 – 21 days.
9. Gift Vouchers
9.1 Gift vouchers can be purchased online through our site.
9.2 Gift vouchers will be emailed to the purchaser in a PDF format.
9.3 Gift vouchers are valid for one year from the date of purchase and cannot be extended.

10. Your information
10.1 We process information about you in accordance with our privacy policy.
11. Intellectual property rights and license
11.1 We are the owner of all intellectual property rights in the products together with the rights in any developments and modifications in such products. We assert the moral rights that we may have in any of our products.
11.2 We will grant you a non-exclusive, perpetual, non-transferable and personal licence to use the products for your own residential purposes at the location set out in the PDF’s and as provided by the client, but for no other purpose.
11.3 You may not allow any third party to use any of the products; use the products on behalf of or for the benefit of any third party; sub-license the use of the whole or any part of those products; recreate the product at a different location or transfer them to anyone else without our prior written permission.
11.4 We own and control all of the copyright and other intellectual property rights in the website and the data, information, and other resources displayed by or accessible within the website.
12. Our Liability to You
12.1 We are under a legal duty to supply products that are in conformity with our contract with you.
13. Events Outside our control
13.1 We will not be liable or held responsible for customers failure to check covenants/ planning laws that may be specific for the address that you the customer has provided. This also includes checking for conservation requisites or tree protection orders.
13.2 Our products and its design are based on a flat garden. If you the customer have an extreme plot with large slopes or level changes then advice should be sought by a reputable professional contractor. If products are used without appropriate changes such as the addition of handrails, gaining planning permission etc. we cannot accept any responsibility for any health and safety failings or planning law breaches that may occur.
13.3 We are not responsible for the works carried out by any contractors. The products are provided to you the customer and it is your responsibility to research, find and employ a reputable, professional contractor.
13.4 We cannot be held responsible for the failure of any plants/trees. Planting plans are based on the use of the British Standard topsoil used by most developers and landscape contractors. If you the customer know that your site has extreme conditions such as heavy clay soil, full sun or full shade it is advised prior to the purchase stage that you contact us directly to discuss an alternative planting plan. This will incur additional fees.
13.5 We cannot take responsibility for any allergic reactions to either humans or animals including pets through any of our proposed planting designs. We have highlighted all plants that pose a ‘toxic if eaten’ threat to both humans and pets. If you the customer have a known allergy to certain plants, then it is your responsibility to omit said plants from your garden.
14. Resolving Disputes
14.1 If you have a dispute with us relating to our contract with you, in the first instance please contact us at info@gardendesignsforall.co.uk and attempt to resolve the dispute with us.
15. Updating these Terms and Conditions
15.1 We may modify or update these terms and conditions from time to time for reasons including how our business operates; (b) changes in legal or regulatory requirements that we must comply with; or (c) changes in how we accept payment from you. However, any order of our products will be governed by the terms and conditions available on our site at the time you place the order.
16. Law and Jurisdiction
16.1 These terms are governed by English Law. This means that a contract for the purchase of our products made through our site and any dispute or claim arising out of or in connection with it will be governed by English Law.
